The SUP Directive targets the 10 single-use plastic items most commonly found on European beaches. Together with fishing gear, these items account for 70% of all marine litter in the EU. The directive applies different measures to different products — but for a defined set of items, placing them on the market is prohibited outright.

It is worth noting that CPLA and PLA cutlery are currently permitted under the SUP framework, but regulatory scrutiny is increasing. The public consultation launched on 23 December 2025 by the European Commission is evaluating whether to expand restrictions to cover certain bio-based and biodegradable plastics. Importers relying on PLA as a fallback should monitor this closely — natural, unblended materials like bamboo and wood face no such ambiguity.

Enforcement: Fines Are Real

Member states have transposed the SUP Directive into national law with varying penalty structures. In Germany, non-compliance can result in fines of up to €450,000 per infringement. France, Spain, and the Netherlands enforce similarly aggressive penalties.

Enforcement is not limited to border customs. National market surveillance authorities conduct spot inspections at warehouses, retail outlets, and distribution centers. A single non-compliant shipment can trigger product recalls, reputational damage, and six-figure fines.

In short: importing banned plastic tableware into the EU is not a gray area. It is a hard stop.

In May 2024, the EU adopted the Packaging and Packaging Waste Regulation (PPWR), which entered its implementation phase in 2025.
